Indiana Charitable Fundraising Laws and Resources

Are you properly licensed for fundraising? Recently an area nonprofit professional asked if we could make available resources on Indiana’s “Professional Fundraiser Consultant and Solicitor Registration Act.” While we aren’t allowed to answer your legal inquiries, and we refer you to practicing attorneys for such, we are happy to share resources that can help you.

Here is the link to the Indiana Attorney General’s webpage with resources on the Professional Fundraiser Consultant and Solicitor Registration Act, Indiana Code § 23-7-8-1 et seq

On the page, you will find links to six documents including:

  1. Professional Fundraiser Consultant or Solicitor Application for Registration
  2. Professional Solicitor Notice Filing
  3. Professional Solicitor Campaign Financial Report
  4. Professional Fundraiser Consultant Disclosure Form
  5. Professional Fundraiser Consultant and Solicitor Registration Act
  6. Professional Fundraiser Consultant and Solicitor Rules
According to the Indiana Attorney General’s webpage,

“All six documents must be downloaded.

In order to register as a professional fundraiser consultant or professional solicitor, return the completed registration form, along with a filing fee of $1,000, to the Indiana Attorney General’s Consumer Protection Division.

If you are renewing your registration, return the completed registration form, together with the $50 renewal fee, to the division before July 2 of each year. Please be advised that a person may not act as a professional fundraiser consultant or solicitor for a charitable organization unless that person has registered with the division.

A copy of the Professional Fundraiser Consultant and Solicitor Registration Act is also listed. While this copy has been reviewed to ensure its accuracy, the Division will not be responsible for any inaccuracies that may exist in the copy. It is the responsibility of the professional fundraiser consultant or solicitor to comply with all of the provisions of the Professional Fundraiser Consultant and Solicitor Registration Act, and to ascertain the laws applicable to their activities in Indiana.”  – http://www.in.gov/attorneygeneral/2379.htm

Here is a PDF, Indiana State Fundraising Registration and Regulation, prepared by Baker and Daniels and made available on LawforChange.org – a site we hope to review for you soon.

  1. As a reminder,

“Under Indiana law, a professional solicitor who is hired to solicit contributions for a charitable organization must register with the Attorney General’s Office. Find the link to this regularly updated list by clicking on the title Current Charitable Solicitations Campaign Chart here.
